That means businesses pay Megaherdz for the right to use the music without having to deal with recurring fees from PROs (performance rights organizations) such as AKM, GEMA, ASCAP, BMI, and similar organizations. If a song is registered with a PRO, business customers could face unexpected royalty claims or additional fees, which would break the Megaherdz model.
Can I register a Megaherdz song with a PRO later?
No. Once a track has been accepted into the Megaherdz catalog, it must remain free of PRO registration or any conflicting rights assignment that would interfere with the rights granted to Megaherdz. This is essential to protect Megaherdz, its partners, and its customers from legal and financial problems.
Can I still release my music elsewhere?
Yes. The Megaherdz agreement is non-exclusive. You keep ownership of your music and can continue distributing and exploiting it elsewhere, as long as you do not take actions that conflict with the rights granted to Megaherdz, especially regarding PRO registration and conflicting rights assignments.
Why does Megaherdz point artists to the website for benefits and perks?
Because the artist benefits ecosystem is growing and can change over time. Instead of locking every current and future perk into the contract, the agreement makes clear that artists should refer to the Megaherdz website for the latest list of available benefits.
Does Megaherdz guarantee streams, sync placements, or income?
No. Megaherdz guarantees inclusion in its official full-catalog playlist for accepted tracks, but it cannot guarantee how often a specific song will be used by customers, whether it will be selected for sync opportunities, or how much revenue it will generate.
Why is the contract so strict if the artist still keeps ownership?
Because Megaherdz does not buy your copyright, but it does need strong, stable licensing rights to run its business. The contract is designed to let artists keep ownership while giving Megaherdz the certainty it needs to license tracks safely and reliably to businesses and creative clients.
What do I actually get in return as an artist?
Artists get access to Megaherdz’s licensing ecosystem, real-world exposure through businesses using the catalog, playlist placement in the official full-catalog Megaherdz playlist, possible placement in additional curated playlists, and access to a growing range of artist benefits and perks. Depending on the current Megaherdz offering, these may include promotional support, tools, discounts, licensing opportunities, and revenue-related benefits.
Is playlist placement guaranteed?
Yes, to a certain extent. Every accepted track is included in the official Megaherdz full-catalog playlist. Additional placement in more specific curated playlists may also happen if the track fits. However, Megaherdz cannot guarantee that business customers or third parties will actively choose, stream, or feature a specific track.
What happens if someone registers a Megaherdz track with a PRO anyway?
That would be a breach of contract. If this causes royalty claims, customer losses, legal disputes, or court proceedings, the artist is responsible for the resulting costs. This includes legal fees, court costs, damages, reimbursements, and any PRO-related charges caused by the violation.
Why does Megaherdz need the right to create stems, instrumentals, or shortened edits?
Different licensing situations require different versions of a song. A business may need an offline file, a creator may need a shorter edit, or a client may need an instrumental or stem-based version. Giving Megaherdz the right to create these versions ensures the platform can work efficiently and serve customers properly. But don’t worry. If you don’t have the stems of your song, Megaherdz will extract them with AI tools, so you don’t have to call your producer to export them.
Why is the Megaherdz license perpetual and irrevocable?
Because Megaherdz licenses music to businesses and creatives who rely on legal certainty. Once a song has been accepted into the catalog and licensed to customers, those customers must be able to continue using it without the risk of suddenly losing their rights. This protects everyone involved and keeps the licensing model stable and trustworthy.
Does that mean I can never remove my song again?
Once a track has been accepted into the Megaherdz catalog, the license granted to Megaherdz for that track is permanent. This is necessary because tracks may already have been licensed, downloaded, added to playlists, or used in creative projects by third parties. Those existing rights cannot be undone retroactively.
Can Megaherdz change my music however they want?
Megaherdz may create technical and licensing-related versions of accepted tracks, such as stems, instrumental versions, shorter edits, loopable sections, and downloadable files. These versions are created to support legitimate licensing use, not to take ownership of your artistic identity.
Why is the liability clause so strict?
Megaherdz relies on the artist’s promise that the submitted music is legally safe to use. If a track contains an uncleared sample, an unauthorized cover element, a rights conflict, or a PRO issue, Megaherdz and its customers could face serious legal and financial consequences. The liability clause makes clear that the artist is responsible if the track was submitted in violation of those promises.
